Litigation

Mr. Heppt aggressively represents clients in a full range of business and commercial disputes.  We provide our clients with reliable pre-litigation advice, choose the appropriate forum to litigate a dispute, prepare pleadings that properly advance our client’s case, engage in strategic motion practice and conduct effective discovery. We are mindful of our clients’ business goals. In many cases, this means that our primary objective may be to reach a speedy economic settlement. However, if our clients’ interests so require, we effectively and aggressively represent their interests at trial.

Did you know? When your insurance carrier agrees to defend a claim, you are often  entitled to select your own counsel. Insurers routinely issue a “reservation of rights” letter when the client submits a claim for coverage. The letter states that the insurer will assume the defense of the claim but will reserve the insurer’s right ultimately to refuse coverage. When this occurs, the insured company has the right to choose its own counsel to represent the company’s interests. Of course, the insurance carrier is obligated to cover the legal fees.

Securities Arbitration

Mr. Heppt has extensive experience arbitrating claims before FINRA and the American Arbitration Association.  He combines his experience and knowledge of the securities industry with an understanding of the arbitration process, its practicalities, procedures, forums and methods of enforcement. Mr. Heppt has successfully handled claims involving allegations of securities fraud, churning, sales practice violations, improper Form U-5 disclosure and employment disputes.

Employment Law

Mr. Heppt has successfully represented clients who have been the victims of discrimination in their employment. He regularly counsels clients regarding employment, non-compete and severance agreements.

Professional Liability

Mr. Heppt has focused on professional liability issues for a good portion of his career. He has represented clients in claims against  lawyers and accountants, in addition to serving on various committees dealing with professional liability issues.

Regulatory Investigations

Mr. Heppt has represented industry professionals and companies during investigations and enforcement proceedings conducted by the SEC, FINRA, state securities agencies and other regulatory authorities, as well as during internal corporate investigations (whether in conjunction with governmental inquiries, litigation, or on a stand-alone basis). If it appears that a matter against one of your brokers or against the firm has some merit, we can either negotiate a reasonable settlement with the self-regulatory organizations or represent you in contested hearings.
